Agreement and Acceptance

These Terms and Conditions ("Agreement") govern all use of The Latina Burnout Coach website and services. By accessing our website, scheduling a session, or enrolling in a program, you agree to be bound by these terms.

Services Offered

The Latina Burnout Coach provides the following services:

• Private 1:1 trauma-informed somatic coaching

• Group workshops and educational programs

• Digital tools and resources (assessments, toolkits, educational materials)

• Educational content on nervous system regulation and personal development

  
  

Professional Qualifications and Limitations

Nicole Torres holds the following credentials:

• Certified in Integrative Somatic Trauma Therapy

• Leadership Coach

• Energetic Healing Practitioner

Nicole Torres is NOT a licensed therapist, psychologist, psychiatrist, or medical doctor. Somatic coaching is NOT a substitute for therapy, psychiatric care, or medical treatment.

Your Responsibilities

By engaging our services, you agree to:

• Provide accurate and honest information about your history and current circumstances

• Actively participate in the coaching process

• Take responsibility for your own health and wellbeing decisions

• Disclose if you are currently working with a mental health professional or physician

• Adhere to safety guidelines established during coaching

Session and Program Terms

Scheduling and Cancellation Policy:

• Cancellations or rescheduling requests must be submitted in writing (email or text) at least 24 hours in advance

• You are entitled to one complimentary emergency reschedule per 3-month coaching period

• Sessions cancelled with less than 24 hours notice will be forfeited

• Repeated no-shows may result in termination of services

Session Confidentiality:

• All coaching sessions are confidential

• Session details will not be shared without your written consent

• Confidentiality may be breached if you indicate danger to yourself or others, or if legally required

Session Recordings:

• You may not record sessions without written permission from Nicole Torres

• Sessions will not be recorded without your explicit written consent

• If a session is recorded with your permission, the recording is provided for your personal use only and must remain confidential

Payment Terms

Coaching Programs:

• Pricing varies based on program and coaching container type

• All pricing, payment options, and terms will be outlined in your onboarding agreement

• Payments are non-refundable due to the custom nature of somatic coaching

• Payment is due upfront or according to an agreed-upon payment plan

• Service suspension may result from repeated missed payments

Workshops and Group Programs:

• Pricing and refund policies vary by program

• Refund terms specific to each offering will be communicated at enrollment

Intellectual Property Rights

All website content, including but not limited to blog posts, coaching materials, frameworks, designs, and resources, is the intellectual property of Nicole Torres / Ouroboros Healing and is protected by copyright law.

Permitted Use:

You may use this content for personal, non-commercial purposes only, including sharing on personal social media accounts. If you share, quote, or repurpose any content:

• You must credit Nicole Torres / The Latina Burnout Coach

• You must tag Nicole Torres with her most current social media handle on that platform

• You must link back to the original source when possible

• You may not modify the content or present it as your own work

Republication, commercial use, repurposing for business purposes, or claiming ownership of this content is strictly prohibited without written permission.

Medical and Mental Health Disclaimers

Health and Medical Conditions:

• Consult with your physician before beginning any new wellness program

• Disclose all relevant medical conditions, medications, and physical limitations

• Somatic work does NOT replace medical treatment but is a proven form of therapy that works in conjunction with other therapies

Nervous System Work:

• Nervous system healing is a powerful process and may bring up intense emotions

• Emotional release during sessions is a normal and expected part of the healing process

• All work is conducted at a pace determined by your comfort and readiness

• You maintain control over the process at all times

Pregnancy and Postpartum:

• If you are pregnant or postpartum, notify both Nicole Torres and your healthcare provider

• Somatic techniques may require modification during pregnancy

Limitation of Liability

The Latina Burnout Coach and Nicole Torres are not liable for:

• Indirect, incidental, or consequential damages (including lost income or emotional distress)

• Decisions or actions taken based on coaching or recommendations

• Technical issues with the website or third-party platforms

• Your use of external services (Calendly, Systeme.io, Kit, Stripe, etc.)

Total liability is limited to the amount paid for services rendered.

Errors and Omissions

Disclaimer:

This Agreement and all website materials are provided "as is" without warranty of accuracy or completeness. While we make reasonable efforts to maintain current and accurate information, errors may occur.

We are not liable for:

• Typographical errors or outdated information in this Agreement

• Incomplete or inaccurate website content

• Technical malfunctions or broken links

• Information provided by third-party service providers

Error Notification and Correction:

Upon discovery of a material error that affects your services, we will:

• Correct the error promptly

• Notify you if the error impacts your coaching or services

• Not hold you accountable for actions taken in reliance on incorrect information

Reporting Errors:

Please report any errors or inaccuracies to nicole@thelatinaburnoutcoach.com.

Termination of Services

The Latina Burnout Coach reserves the right to terminate the coaching relationship if:

• You do not engage actively in the coaching process

• Your behavior poses a safety risk to yourself or others

• You violate these Terms and Conditions

• The professional relationship is no longer a good fit for either party

Termination will be communicated in writing, and we will discuss next steps and available resources.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes are effective upon posting to the website. Continued use of our services constitutes your acceptance of updated terms.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

What Somatic Coaching Is and Is Not

Somatic coaching is a form of personal development coaching that addresses how trauma and stress are held in the nervous system and body. It is designed to support healing and personal growth through body awareness and nervous system regulation.

Somatic coaching is NOT:

• Psychotherapy or mental health counseling

• Medical treatment or diagnosis

• A substitute for psychiatric care

• Licensed mental health treatment

Nicole Torres's Qualifications:

What Somatic Coaching Addresses

Somatic coaching helps clients:

• Understand how trauma and stress manifest in the nervous system

• Develop skills for nervous system regulation

• Release stored tension and emotional patterns

• Reconnect with body awareness and intuition

• Build sustainable personal and professional success

What Somatic Coaching Does Not Address

Somatic coaching does NOT:

• Diagnose mental health conditions or disorders

• Treat PTSD, anxiety disorders, clinical depression, or other diagnosed conditions

• Replace therapy or psychiatric medication

• Prescribe medications or supplements

• Address active suicidality, self-harm behaviors, or psychotic episodes

When Professional Mental Health Treatment Is Necessary

If you experience any of the following, seek immediate help from a licensed mental health professional:

• Suicidal ideation or self-harm urges

• Severe panic attacks or anxiety episodes

• Diagnosed depression or mood disorders

• Psychosis or loss of contact with reality

• Substance abuse or addiction

• Severe or unprocessed trauma

If You Are Currently in Therapy

If you are working with a therapist or mental health professional, we recommend:

• Informing your therapist that you are also engaging somatic coaching

• Coordinating care to ensure aligned and complementary treatment

• Providing Nicole Torres with your therapist's name for care coordination purposes

Burnout Coaching Scope and Client Responsibility

What Nicole Torres Coaching Does for Burnout:

Somatic coaching supports burnout prevention and early intervention. It helps you recognize burnout patterns, regulate your nervous system, and build sustainable systems that support wellbeing before burnout reaches crisis levels.

What Somatic Coaching Does NOT Do for Active Burnout Crisis:

If you are in active burnout crisis - meaning you are severely depleted, unable to function, experiencing physical or mental health collapse, or showing signs of serious depression or anxiety - somatic coaching is NOT sufficient treatment. In these cases, you need evaluation and support from a licensed mental health professional and medical physician.

Your Responsibility as a Client:

You agree to:

• Be fully honest about the severity of your burnout and stress levels

• Disclose all relevant mental health history, medications, and diagnoses

• Recognize when your burnout has progressed beyond what coaching can address

• Seek professional medical evaluation if you experience severe depression, anxiety, physical symptoms, or crisis thoughts

• Follow Nicole Torres's recommendations for self-care, rest, and professional support

• Take responsibility for your own health decisions and seek appropriate help

Nicole Torres's Liability Limitations:

Nicole Torres is NOT responsible for:

• Outcomes or worsening symptoms if you do not fully disclose your mental health history or current condition

• Your health declining if you ignore warning signs or recommendations to seek professional help

• Results if you do not follow suggested self-care practices or nervous system regulation techniques

• Worsening burnout if you do not take action on recommendations to rest, set boundaries, or reduce workload

• Decisions to remain in harmful situations instead of seeking additional professional support

• Any health consequences resulting from non-disclosure, ignoring warnings, or refusing to follow guidance

Clear Communication:

During your coaching work, Nicole Torres will be direct about when your situation requires professional medical care beyond coaching. If she recommends you seek additional support, this is not a reflection on you - it means your needs require specialized professional intervention that coaching cannot provide.

Prior to Beginning Coaching:

• Consult with your physician before starting any new wellness program

• Disclose all relevant medical conditions, medications, and physical limitations in the onboarding and client intake documents

• Somatic work does NOT replace medical treatment but is a proven form of therapy that works in conjunction with other therapies

Nervous System and Somatic Work:

• Nervous system healing is a potent process that may bring up intense emotions and physical sensations

• Emotional processing and release during sessions are normal and expected

• All work occurs at a pace determined by your comfort and readiness

• You retain full control and agency throughout the process

Pregnancy and Postpartum:

• If you are pregnant or postpartum, inform both Nicole Torres and your OB/GYN

• Certain somatic techniques require modification during pregnancy

Your Responsibility and Acknowledgment

By engaging with Nicole Torres for somatic coaching, you acknowledge and agree that:

• You understand somatic coaching is NOT therapy or medical treatment

• You assume full responsibility for your health and medical decisions

• You will seek professional help if you experience a mental health crisis

• You will not hold Nicole Torres responsible for outcomes or results

• Healing is a personal process and results vary based on individual circumstances

Limitations and Non-Guarantees

We do not guarantee specific results or outcomes. The effectiveness of somatic coaching depends on multiple factors including:

• Your commitment and active participation

• Consistency with practices and techniques

• Your individual circumstances and life situation

• Your readiness and openness to change

Confidentiality and Mandatory Reporting

Your sessions are confidential with the following exceptions. We are legally required to break confidentiality if:

• You indicate you are a danger to yourself (suicidal thoughts, self-harm)

• You indicate you are a danger to others

• Child abuse or neglect is disclosed

• A crime is being committed or planned

• A court orders disclosure of information
